Here’s what I got from my attorney on Monday, October 1st 07. It seems there was a conference call of some sort with USCIS officials past week. Thought this will just keep you informed if you haven’t heard about this yet. Please check with your attorney for confirmation.
Below is the summary FYI only.
1. Expect further retrogressions on the visa bulletins
2. USCIS received approximately 800,000 total applications in July and August in addition, they received 100,000 family based I-485 cases in July
3. Do not expect premium processing to be re-instated for I-140s for a while
4. There is a big problem with the receipt notice updates that are being published by USCIS—they are not accurate and they are further behind than they are publishing. Aytes is trying to fix this discrepancy.
5. If you submitted photos with the EAD applications, then Aytes said you will get your EAD faster than those who did not
6. Expect changes in regulations to permit H and L people to travel without the I-485 receipt notice due to the major backlog in receipting
7. Aytes said they are trying to set it up that next year the EAD and Advance Paroles will be issued for more than a one year expiration and that there may possibly be one document issued for both the EAD and APs. More on this will come by the end of the year.
8. Backlog Elimination Centers (BEC) should be up to date in one month
9. Since the BEC will be updated, Carlson said to expect an increase in audits for the PERM cases at the end of this year and next year----make sure ALL of the recruitment requirements are being met; no fraud involved; employees not being required to pay or pay back labor expenses; employees not involved in the recruitment, etc.
10. 20% of PERM cases are being denied
11. Atlanta’s motions for reconsiderations should be processed faster soon
12. New PERM form on March 28, 2008
13. Carlson stated that the DOL’s position on attorney fees are the foreign national can have an attorney represent him/her for letters of support, previous job descriptions etc. to prepare for the upcoming I-140 stage and ensure that he fits the already prepared job offer requirements, but ALL fees and costs associated with the PERM filing (job offer requirements, advertising, recruitment, preparing the form, filing the form, motions, etc) MUST be paid by the company. FAQ’s are on the DOL website.
14. Work site enforcement----expect CIS officers to request to see I-9s---Make sure the I-9s are being properly completed by the employers.
15. I-9 raids are a hot topic!!!! For example, the city Reno (NV) saw several McDonald restaurants raided on Thursday—this is expected to happen all over the USA and with all types of employers. PLEASE make sure you have the I-9s in a separate place and handy in case of a raid. If I-9s are with other paperwork, then the raiding officer will review it all!
16. WATCH OUT FOR DUIs---in both nonimmigrant and immigrant cases!!! Delays are occurring in these cases.
17. The US consulates and CBP are Googling you!

its fine. Your salary should match the LCA salary. The LC salary is for 'future job'. the only place it might come into play is if your employer is very small, and there are ability-to-pay issues (here, if your current salary matches LC salary then its easier to say that employer has ability to pay).
Thank you all for your expert advice!!.. My I140 was approved about a year back.. I am working for one of the top 10 outsourcing co.. so it is very unlikely that they will do an error though we can't be certain..

My 180 days have passed and I have an approved 140. My job was filed in 2002 in EB2 as s/w engg. In this job i moved to project manager in IT. Now I am getting a job offer for an awesome company, nice pay and as a program manager. the role is still in IT but it will be more managing.
Would this be a safe bet to take by choosing AC-21?

Use EAD to join the company but during I-485 process if they ask for EVL keep a back up company which can give EVL with Labor job description. Hope this helps.

Ok move over Prez elections..what happens in 09 after the Prez election..the current senate is the same..which refuses to pass any immi bill..just because the Prez elections will get over this year..why are we expecting that next year any bill will pass??..

Why we are expecting that something next year? One Word. Politics. The current congress will not do anything now, because, they dont want to alienate 1 particular group during an election year. Now, I am not saying that they will do anything in '09. But, with more lobbying, we might see some success.

A little over a months time, I received a letter saying that the typo on my last name has been corrected. I could confirm that since the mailing address had all the correct details.
Hence, I guess, their typo correction system is a bit slow but it works!

For people familiar with how databases work:
You have to realize that each page load means a query has to run to a table of 14,000 records (for 14,000 threads) in MySQL database on our limited capacity server and since you have to sort the rows on basis of most recent updates, you have to get all 14,000 rows of result set and then let database sort them in descending order.
The reason for messed up sort order is that the "recent forums posts" has been pointed to a separete table that has recent threads and that seperate table is populated every 1 or 2 minutes from entire table of threads. That's sometimes you update a thread and it takes a while for it to become most recent thread.
For some reason, and we dont know yet, our site has been over loaded. This used to happen during July bulletin and we did the same work around by pointing "recent forum posts" to a smaller table populated thru a stored procedure running every few minutes. Also, during the July bulletin, we upgraded the server processing capacity and doubled the memory. It may be time to upgrade again, or maybe its time for some tune-up with regards to creating an index on the table for threads.

I applied My and My Spouse EAD on July 12, 2008 and Notice date July 15, 2008 and we both got our EADs approvals on Aug 08, 2008 and we did receieved 2 Years EADS on Aug 19, 2008. I am EB-3 I PD SEP-2004.

Hi all,
We applied for my wife's and mine EAD on April 27th (paper based)
I got the receipt notice on 05/08/2010 and checks were cashed on 05/08/2010
I am okay, because I am on H1B, my wife has a business and employs 2 people full time.
She doesn't draw any salary from the business, except she has business on her name and the accounts on her name as well.
Additionally , she has a valid H4 as well.
I know its too early to panic, but if I didnt get her EAd card by July 31st, are we in trouble
